Ronald Bishop v. United States
IFP petition · United States Court of Appeals for the Second Circuit, No. 25-2157 · judgment March 23, 2026
Question presented
Does a defendant facing dual prosecution by state and federal authorities for the same drug dealing conduct “waive” his right to seek a concurrent sentence (pursuant to U.S.S.G § 5G1.3(b)) when the record unequivocally shows that he never was advised that he faced a consecutive sentence until six years later when the government sought, for the first time, a consecutive sentence which the district court granted despite petitioner’s satisfaction of the prior state sentence.
