Willie David Lark v. United States
IFP petition · United States Court of Appeals for the Sixth Circuit, No. 25-1337 · judgment July 8, 2026
Question presented
I. Whether, under 18 U.S.C. § 3161(h)(7)(A), a court of appeals may uphold a district court’s wait for future appellate guidance as an ends-of-justice continuance when the district court never found that the ends of justice served by the delay outweighed the public’s and the defendant’s interests in a speedy trial. II. Whether, at the preliminary stage under Franks v. Delaware, 438 U.S. 154 (1978), a court may deny a hearing by reconciling materially different sworn accounts of the same event given by the same affiant to different issuing magistrates.
