Question presented

QUESTION 1: Once a court concludes that a prisoner had NEVER made threatening statements or become physically violent in the forced medication context, can it trample, circumscribe and self-overrule(MID vs. SJ Flip) his First Amendment Right with its own opinions in the name of "appropriate deference to medical professional’s judgment"? QUESTION 2: (Double Jeopardy: Ruling on credibility + Violation of Neutrality) In order to decide with "undisputed facts", after crediting plaintiff of being non threatening & non-violent, can a U.S. Court design a de novo defense theory(Court's: "Peaceful words + non-violent noncooperation" vs. Defendants': "Overt Threat/Violence") on defendants' behalf? QUESTON 3: Undisputed facts from Plaintiff(Appx. I, Page 17-92) prove that, as medical profession als, defendants had knowingly made misdiagnoses, fabricated/falsified medical records, and made untruthful allegations under oath. Can U.S. Courts still afford "appropriate deference to their exercise of professional judgment"?
