Suvad Dardagan v. Justin Maher, Warden
IFP petition · Appellate Court of Illinois, First District, No. 1-25-0047 · judgment September 24, 2025
Question presented
I. Petitioner has never been accused of, arrested for, or charged with a violation of any criminal offense in any court legally constituted in the United States. Whether in the absence of appearance or acquiescence of the State's Attorney, a judgment entered by a court, having no jurisdiction over either the parties or the cause, is absolutely void? II. The entire judicial system depends on proper and accurate document filings by the clerk of the court. If the trust and confidence in the clerk of the court erodes, the entire judicial system collapses. When a trial court announces a final judgment and terminates further proceedings in the absence of a signed written order, the judgment of the court is not either final or appealable. If four months later the clerk of the court backdates a signed written order to appear that it was filed on the date an oral judgment was pronounced, to justify the pronounced judgment, whether the decision of the reviewing courts to dismiss appeal is absolute nullity?
