Phillip Timothy Howard v. United States

Whether the judgment of the United States Court of Appeals, Eleventh Circuit, so far departs from the accepted and usual course of judicial proceedings, or sanctions such a departure by the district court as to call for the exercise of this Court’s power of supervision in that it affirmed the conviction and sentence imposed on Dr. Howard where:

1. the record is clear that the guilty plea was entered to avoid a seven-week trial with possibly 75 witnesses, and

2. there was no evidence of mens rea, because Dr. Howard did not proximately cause harm to any alleged victim and was not guilty of a RICO of one?
