More than four and a half years after being released from prison, and a year after completing her sentence in full, she was resentenced to an additional 100 months of incarceration. The question presented is: May the government, consistent with the Double Jeopardy Clause and Due Process Clause, enlarge a criminal defendant’s sentence and recall her to prison after her initially imposed sentence has been fully served and she has returned to society?
