1. Is the National Instant Criminal Background Check System (NICS) constitutional or not ?

2. Does the American government have a right to violate the specific words of the Second Amendment ? That the right of the people to bear arms shall not be infringed.

3. Can an individual citizen claim his right under the Constitution as it is written? That a citizen already has the right to keep and bear arms and that the government shall not infringe on that, or is that no longer the reality in the United States ?
