In a matter of first impression whether the district attorney may charge a person for causing a death that the coroner declines to find was a homicide, after a forensic pathologist and chief medical examiner concur that there was no foul play and issue a death certificate? Whether this is in error of the sub-delegation doctrine violating Colo. Const, art. VI §13, Colo. Const, art. XIV, §8 C.R.S 30-10'606, usurping the Coroners authority?
