Miguel Abreu v. United States

IFP petition · United States Court of Appeals for the Second Circuit, No. 24-1844 · judgment September 18, 2025

Certiorari denied · February 23, 2026

Question presented

Petitioner Miguel Abreu possessed a gun only because, during a dispute, he disarmed another person and then retreated. Because he had two prior felony convictions, he was charged and convicted of violating 18 U.S.C. § 922(g)(1). The question presented is whether 18 U.S.C. § 922(g)(1) is unconstitutional on its face or as applied to Mr. Abreu because, consistent with the Second Amendment, the federal government may not permanently disarm citizens like him, preventing them from defending themselves.
