I. Whether, pursuant to Alleyne v. United States, 570 U.S. 99, 133 S.Ct 2151, 186 L.Ed.2d 314 (2013) and Apprendi v New Jersey, 530 U.S. 466, 120 S.Ct 2348, 147 L.Ed.2d 435 (2000), the district court erred in finding that the Appellant was subject to an enhanced statutory maximum of life imprisonment, rather than a maximum sentence of 20 years imprisonment, on a conviction for RICO conspiracy when the indictment did not charge an enhanced sentencing provision under 18 U.S.C. § 1963.
