Title II of the Americans with Disabilities Act and Section 504 of the Rehabilitation Act of 1973 prohibit discrimination against a qualified individual with a disability. 42 U.S.C. § 12132; 29 U.S.C. § 794(a). A “qualified individual” is one who “meets the essential eligibility requirements” for the program. 42 U.S.C. § 12131(2). The courts of appeals are divided over the following question: Whether, under Title II of the Americans with Disabilities Act or Section 504 of the Rehabilitation Act, a defendant bears any burden to demonstrate that an eligibility requirement is essential.
