This Petition presents the question of whether state law supersedes the federal substantive law of res judicata in determining whether a federal final judgment is binding as res judicata in state court. Departing from this Court’s precedent, and in conflict with both federal circuit courts and other state appellate courts, the Second District Court of Appeal of Florida affirmed a state court’s refusal, on state substantive law grounds, to apply federal substantive law of res judicata in determining whether a federal final judgment was binding in state court.
