Question presented

When a federal inmate files a motion for reduction of sentence or compassionate release pursuant to 18 U.S.C. § 3582(c)(1)(A), the district court must assess whether the prisoner is still a danger to the community. See U.S.S.G. § 1B1.13(a)(2) (2024). Prisoners may include in such a motion new evidence of their post-sentencing rehabilitation that was not considered at sentencing or any prior motion. The question presented is: Whether a district court errs when it denies a motion for reduction of sentence or compassionate release under 18 U.S.C. § 3582(c)(1)(A) on the ground that the defendant remains a threat to the community based solely on the defendant’s offense and criminal history or the court’s denial of a prior motion, without considering or discussing new evidence of rehabilitation presented by the defendant with the motion.
