As the first and only sanction ever ordered – or even considered – by the District Court below, that court struck Petitioner Christy Williams’ liability experts in a product liability action, then immediately granted a summary judgment based on Petitioner’s being left without liability experts as required under Texas law, and thereby depriving Petitioner from a trial on the merits. The question presented is whether Petitioner has been deprived of “the right of trial by jury” as protected by the Seventh Amendment and Fourteenth Amendment. See U.S.C.S. CONST. AMEND. 7, 14.
