Whether a trust has arisen and a fiduciary relation exists between the petitioner and respondents, their heirs and assignees who are people bound by oath to be Persons worthy of trust. Whether there exists a conflict and variance between the rules of law and the rules of equity. Whether equity looks to the intent, and will regard substance rather than form. Whether the petitioner is entitled to an equitable remedy and equitable relief for the irreparable harm done to him as the beneficiary with a beneficial interest as a people called Moors.
