Question presented

In a related RICO action, former Georgia Attorney General Sam Olens made knowing misrepresentations about University System of Georgia (USG) finances in order to block a hearing required by USG policy and obstruct a criminal investigation of the USG— later discovered to be engaged in a multi-billion-dollar fraud in federal funding scheme. Post-obstruction, the USG Board of Regents appointed Olens—as the sole candidate considered, in violation of Board of Regents policies—to a $500,000 a year position as president of Kennesaw State University (KSU)—after the USG removed the sitting president, with Olens’ knowledge, through extortionate threats. When Petitioners sued to enjoin the Olens appointment as part of an ongoing RICO scheme, the Attorney General appointed by the Governor to replace Olens never filed a responsive pleading to the instant KSU action. In the face of more than a year of Petitioners’ uncontested pleadings, the trial court ruled against Petitioners in a one-sentence order with no explanation. The Georgia Court of Appeals refused to hear Petitioners’ appeal. Conflicted justices on the Georgia Supreme Court refused to recuse and also refused to review the denial of constitutional due process in violation of their oaths of office. 1. Whether the total breakdown of Georgia’s justice system—in which the state never responded to documented allegations of fraud, obstruction, bribery, and extortion, and the courts denied review of uncontested corruption by political allies—is such a flagrant violation of constitutional due process and the rule of law that this Court must order a summary reversal to require actual adjudication of the cause below under the governing laws.
