More than 35 years ago, Anthony Hines stabbed Katherine Jenkins to death at a motel in Kingston Springs, Tennessee. The Sixth Circuit invalidated his decades-old murder conviction and death sentence on the ground that a state court unreasonably applied Strickland v. Washington, 466 U.S. 668 (1984), when it concluded that Hines suffered no prejudice from any deficiencies in his counsel’s performance at the guilt and penalty phases of his capital trial. The question presented is whether the Sixth Circuit’s decision conflicts with the Court’s precedents governing claims of ineffective assistance of counsel under the Antiterrorism and Effective Death Penalty Act of 1996.
