Whether the First Amendment provides a person the right to say offensive, derisive or annoying words to any person who is on the speaker’s private property and who is free to leave at any time. Whether the Federal Rule of Civil Procedure 9(b) requires a plaintiff to have personal knowledge of relevant facts within the defendants’ exclusive control and where without doubt, the defendant knows of the fraud and persons responsible.
