The Merit System Protection Board (MSPB) has jurisdiction over an applicant's disqualification, because of a suitability determinations (5 C.F.R. § 731.103(d), 5 C.F.R. § 731.404, 5 C.F.R. § 731.501, 5 C.P.R. § 1201.3(a)(7))(2001), 5 U.S.C. § 7701(a). The Question presented: 1. Whether the MSPB lacks jurisdiction over OPM's December 27, 2004 5 C.F.R. § 731 et seq. determination, a new and material OPM determination; amending and vacating OPM's May 16, 2001 suitability charges, disqualification determination, debarment, and reinstating Petitioner's employment eligibility as a preference eligible veteran pending MSPB SE-0731-01-0261-I-2 appeal?
