Whether the State of Mississippi is in direct conflict with Cheek v U.S. when they enhance their fines "greatly in excess of the normal tax imposed" without any evidence or testimony of the defendant's "willfully or wantonly" violating any law. Whether the Mississippi's "right to counsel" rules and legislation are in conflict with the 6th Aniendment guarantee to "assistance of counsel" when a defendant's "assistance of counsel" is limited to those that are lawyering forprofit, which are "licensed attorneys". Whether a State, that has a two-tier system, violates the 14th and 5th amendment due process protections when it mandates the imposition of substantial financial burdens on a defendant to chill the exercise of his absolute right to a trial de novo where full constitutional protections are available.
