In Gasperini v. Center for Humanities, Inc., this Court held that “[n]othing in the Seventh Amendment * * * precludes appellate review of the trial judge’s denial of a motion to set aside [a jury verdict] as excessive.” 518 U.S. 415, 436 (1996) (internal quotation marks, citation, and footnote omitted)). As the Court noted, appellate review to ensure that the weight of the evidence supports the damages awarded “is reconcilable with the Seventh Amendment as a control necessary and proper to the fair administration of justice.” Ibid. The question presented is: Whether, as the Second Circuit holds, the Seventh Amendment categorically bars review of district court denials of motions for a new trial made on the ground that the weight of the evidence does not support the verdict or whether, as all other geographic circuits hold, such denials are reviewable.
