I QUESONS PRESENTED Whether the Federal Circuit has erred stating in its opinion that "The parties agree that the Order is not an injunction" despite the fact that parties agree that the Order is an injunction, according to the parties' statements in their Briefs. Whether the Federal Circuit has erred dismissing as not , injunctive ("lack subject matter jurisdiction") of the PlaintiffsAppellant's appeal of the evidentiary injunctive District Court's Order, ordering Plaintiff to ".. cooperate with all requests of - the [patent] receiver and are enjoined from interfering with the receiver's performance of its duties hereunder" (emphasis added), despite the fact that word "enjoin" has determined in the dictionaries, encyclopedias and parties' Briefs as an "injunction". Whether the Federal Circuit has erred not making decision upon the Plaintiffs-Appellant's appeal of the District Court's Order, ordering that ". .any sum paid by Defendant [upfront directly] to [the patent receiver] shall be added to the judgment [against PlaintifEl . . " (emphasis added) despite the fact that the law requires that "...the costs of a receivership are primarily a charge upon the property in the receiver's possession and are to be paid out of said property".
