Question presented
Petitioner alleged that Respondent's two lawyers, Mr. Butch Hayes and Ms. Myra Cars maliciously and intentionally denied him a lunch break and access to his medication for 12 hours as an individual qualified with diabetes during the EEOC Negotiated Settlement Agreement Mediation on November 26, 2012. Hence, Petitioner was denied access to both meal, and his diabetic medication from 7 am to 7 pm. Petitioner mediated without lunch break nor took his prescribed medication for twelve hours as an individual qualified with diabetes. The Fifth Circuit's abuse of discretion conflicts with the decision of another United States court of appeals on the same important matter, its ruling, and this Court precedent. The question presented is whether such conduct by Respondent is egregious and sufficiently reprehensible to justify a violation of the constitution. The Fifth Circuit declined to rule on Petitioner's claims on Respondent's tortious interference and providing negative references to prospective employers about him. Immediately, these ongoing unlawful employment practices began after Petitioner accepted the voluntary retirement plan on November 26, 2012. Petitioner argued the merit of these unlawful conduct at the Fifth Circuit Court of Appeals stating that they have continued to harm him to this date.
