The counselor for FNB South made a response to the U.S. District Court alleging: "In all three cases, Defendant was found to have acted appropriately with respect to every account that Plaintiff had at Defendant's bank" (dkt 14 p 1) The bank is liable under the ECOA if the creditor takes an adverse action against .a qualify applicant. The Petitioner is requesting the Court to bring closure to the following questions below. Whether, or not, FNB South after being paid in full on June 23, 2004 had right to continue the deed to secure debt on property. Whether, or not, the bank had right to add the personal property to security agreement in 2007, for an additional 19 years. App. A. and App. B.
