Whether the draft in question issued on September 23, 2013 in the amount of $28,542.84 as an full and final settlement against the 2.5 Million dollar Multi-Tier Claims, based only on the Withheld Preliminary & Tentative Kim & Wright Accounting Report in which was completed on July 9, 2013 yet only submitted and surfaced for the first time, January 15, 2015, 1.5 yrs. and 1 week prior to the Motion of Summary Judgement as an affirmative defense caused the court on the motion of reconsideration to recognize the importance of "Oral Argument" By exercising the discretion vested in the court in such matters", that Honorable Judge Esther Salas, US.D.J. signed an order of oral argument to be heard on June 30, 2016. "If parties are unable to reach a settlement, the undersigned (Judge Salas) will conduct an oral hearing of plaintiffs pending motion, immediately following conclusion of the settlement conference with Magistrate Joseph Dickson."
