INTRODUCTORY STATEMENT The case went to the District Court for the State of New Hampshire where Judge Landya McCafferty did not dismiss it for cause as the government requested. Her Honor did say that the case should be brought in the Court of Claims. The petitioner then brought only the issue of venue to the Appellate Court for the First Circuit and First Circuit affirmed the decision of the District Court as to venue. QUESTION PRESENTED FOR REVIEW The question before the Court is one of jurisdictional venue whether the case belongs in Federal District Court - for the State of New Hampshire or the Court of Appeals in Washington D.C.
